Flickr Images & Copyright Question

When we create themes using Artisteer and its new Flickr add-on capability, are those images we are shown copyright-free so we can create themes, using the flickr capability and images we find through it, and then sell our original themes to clients? It seems that this is the case, but I wanted to make sure.

Also, if this is the case, can we use those flickr images to create downloadable themes that can be sold to sites such as ThemeForest or other company sites?

Looking at things, as long as you acknowledge the creators of the images, you are good to go, but then again, I'm not an attorney. Getty images makes a fortune from suing people for using their images illegally. In some cases they were awarded more than $5,000 per image.

I would use caution, and get a written confirmation either by Artisteer, or directly from thethe cretors of the images, before doing anything.

In general, and according to Artisteer, it's ok to use the supplied images for your web sites, or for your customer's web sites. But now, you are talking about distribution though themeforest.

To stay out of trouble, I always use images from http://www.sxc.hu/

Most are completely free, and are high resolution, but some you need to have a link to the producers, and some you even have to notify them about your intend. But again, most are free, just download them, and do whatever you want with them. BTW, the site was bought by Getti Images few weeks ago... so I'm shocked that it's still free.

On the bottom of the page it says: images by flickr. I checked out the images, but did not use any of them, so how do I get rid of that footer? It is still there even though I did not use it.

You can't within Artisteer. You have to do it manually. Looking at the site it seems that it is a static html. So do a quick check in each html file for the text, and delete it. You only have 3-4 pages, so it's a 2 minute job.

As far as the line goes, that's even easier, Layout -> Columns Section - Column Style -> "Without Style".

I decided to use my own photos and simply go our with my camera as I am a semi pro photographer. Even this is not as simple as photos used in commercial applications - ads, brochures, posters, greeting cards, catalogs, postcards, kiosks, trade shows, Web sites, etc. - will need a release from your subject in order to be "legal." ;-)
