I want her sister to do a commercial site and wants to use the template background images characters from the movie Madagascar. Images from this film, they are still available only on Google. The fact hat DreamWorks have not answered your request cannot be taken as approval. Can't you get an artist to create your own cartoon animal characters?

Don't assume that your website will stay below DreamWorks lawyers radar.

Even when you THINK you're getting a legit image, you may still be violating copyright. The first port of call will be the website owner who, in turn, will sue you. Even though you have written, in fact - worse now - because you have written you actually have begun proceedings against yourself. If DW catch you they just produce your email - bang! Intent established.

I got an image of Clker.com or something like that. I looked at their copyright info and I was OK to go without asking anyone. A week ago I got a nasty letter from Getty Images (go ahead and Google them - you'll see where no authorization can go).

Getty employ a 3rd party to scan the internet for use of their images and then check to see if it's licensed. Don't assume DW won't be doing the same thing.

Visit http://Istockphoto.com and license an image from them for about $25 you can license a cartoon image and use it in your customers design.

You cannot print there on tee-shirts, mugs etc, or use it as a brand logo without an extended licence, but as a website background image etc: it is fine.

You cannot sell templates and designs which include the supplied Artisteer Header Forground Images. But you can sell templates created with any of the other Artisteer images e.g. glare and background images.

You may sell templates and designs with Artisteer forground images if they are for your clients i.e. you sell a design service too and not just templates for download etc.
