Sometimes users have to make changes to their theme when a new wordpress version is released, so how quickly would Artisteer release a new version of itself so the themes made in artisteer are 100% compatible with a new wordpress version?

For the most part, those who have to 'modify' their themes when a new version of Wordpress comes out have to do that because they have customized the code, not because of the basics of the theme.
So far, Artisteer has been pretty good about updates and some minor issue were found and they have had a release in the past month to deal with some of those issues.... so I'm not worried.

I noticed that in the footer of Artiseer templates menu links "contact us | Terms of Use | Trademarks | Privacy Statement" but they are missing from the exported WP themes, is this deliberate or a bug?

Lee,
actually Artisteer does not create a content for your blog, it only creates a design for possible blog components. You need to fill Footer's content in WP. In general edit the footer.php page of relevant Theme. Here is a couple of links which may be useful
